Beeropedia.org internet website regulations
§ 1 GENERAL PROVISIONS
- These regulations stipulate the rules of rendering an electronic website by means of beeropedia.org website owned by Piwopedia* for the benefit of the users.
- The website consists in:
- providing free-of-charge access to beeropedia.org website (further referred to as ‘beeropedia.org’ website),
- free-of-charge maintaining on beeropedia.org sites with photos, films and other internet user entries (further referred to as ‘blogs’) of total disc capacity not exceeding 25 MB per single blog,
- free-of-charge publication of photos, films and contents placed single-handedly by the users,
- free-of-charge publication of users’ comments,
- nominating the best blogs.
- Before setting up a blog the user needs to study the contents of these regulations and accept all terms of using beeropedia.org as presented below. Refusal to accept the regulations will be equivalent to exclusion from setting up a blog and using the websites.
- Before placing any content at beeropedia.org or adding a comment at beeropedia.org website, the author needs to study the regulations and unconditionally accept all terms of using beeropedia.org sites.
- Piwopedia hereby reserves that the regulations and terms of using beeropedia.org sites may undergo changes at any time. The date of introducing changes to the regulations is regarded the date of publishing the new version of the regulations at beeropedia.org. In the case of changing the regulations, Piwopedia undertakes to make available information on the subject at beeropedia.org. The user unconditionally accepts this form of informing about changes to beeropedia.org regulations.
- Piwopedia may introduce a disc capacity limit for a single blog other than that stated above in section 2.B. Piwopedia may also at any time bar access to a given blog or limit to any extent the possibility of adding new content to a given blog. Piwopedia also reserves the possibility of removing a user’s inactive blog assuming that lack of activity means no new entry or added comment within 3 months. In such case the contents will be permanently removed from the beeropedia.org internet server.
- The user who sets up his/her blog will have the right and technical abilities to remove at his/her discretion any entry or comment added by another user without necessary explanation or prior information on the fact.
- Using beeropedia.org sites and the related information in the registration and edition forms is completely voluntary.
- Piwopedia reserves the following technical requirements necessary to co-operate with the telephone and IT systems of beeropedia.org: Microsoft Internet Explorer PL browser in one of the 6.X versions, multimedia Plugin Macromedia Flash 8.0 (MX 2004). The website has been optimised for screen width of 1024 pixels.
§ 2 USER REGISTRATION
- At registration the user discloses exclusively his/her Email address, gender, country and chooses his/her available anonymous nickname. Extra information necessary to register is the choice of the user’s province of residence in order to group users regionally.
- Piwopedia ensures that the Email address as quoted by the user will not be transferred or sold to any third party.
- In particular, Piwopedia reserves the right to use beeropedia.org user’s Email address to send:
- the registered blog’s data,
- information on news at beeropedia.org
- notifications of comments added on the blog by other users,
- technical information on applying the regulations,
- information on Piwopedia offer and products as well as those of partner companies.
- The user may at any time remove his/her blog from beeropedia.org and at the same time demand removal of his/her Email address from the beeropedia.org website system. In order to do that, he/she is obliged to send his/her application for blog removal from beeropedia.org by Email to kontakt@beeropedia.org from the active address from which the user was registered and the blog set up. The act of sending such an Email will be equivalent to removing the blog indicated by the user and to removing the user’s Email address from the website system within no longer than 30 days. The above does not violate the provisions of the promotion regulations or contests announced at beeropedia.pl. Removing data from the beeropedia.org site system may result in limiting participation or winning in promotions or contests referred to in the former sentence.
- The user of beeropedia.org accepts Cookies solutions employed during connections with the websites in all cases used for content profiling or saving the user’s individual settings. Information made available owing to Cookies installed on the user’s computer allow for an anonymous, statistical analysis of the user’s activity on the website and contribute its development and streamlining.
§ 3 COPYRIGHTS PROTECTION
- The user of beeropedia.org declares that he/she has all respective copyrights to all materials sent and placed on his/her photoblog or other websites, in particular photographs and texts.
- By virtue of the above made declaration the user assumes full legal responsibility.
- In case of any claims put forward by third parties, after notification by Piwopedia the user will not avoid immediate provision of explanations and will reject such claims at his/her own cost and risk. He/she will also satisfy any justified claims and in the case of adjudication thereof from Piwopedia, he/she will return by recourse to these entities all covered claims and any related expenses and fees, including costs of proceedings at law and lawyers’ service. He/she will also compensate for any other damages resulting from the above described claims by third parties.
- As for a suspicion that a photo or text placed at beeropedia.org could be placed unlawfully, the person having such justified suspicion may report to Piwopedia his/her reservations by Email sent to kontakt@beeropedia.org. For such an application to be valid, Piwopedia expects the author of the disputable content to present the legal title to the work in possession and unlawfully copied. Each time after considering the claims justified, Piwopedia will permanently remove the unlawful material from the website not later than within 30 days upon notification.
- In case of a suspicion that a photo or text placed at beeropedia.org may violate another person’s privacy, that person should notify Piwopedia about his/her reservations by Email to kontakt@beeropedia.org. In such case Piwopedia will summon the user violating personal goods to voluntarily and immediately stop violating them. Should the summoned user fail to cease to violate these rights, Piwopedia may decide to permanently remove the disputable material from the website not later than within 30 days upon notification. The above procedure does not limit the notifying party’s rights to assert his/her claim by recourse to the law.
§ 4 FORBIDDEN CONTENT
- The users are forbidden from publishing on the website any contents like photographs, graphics, films, texts and other materials whose contents are illegal or which violate social and moral standards, including in particular:
- contents commonly regarded rude and offensive,
- containing elements of nudity, pornography, eroticism and obscene contents,
- insulting other people’s feelings, including religious feelings,
- depicting violence or materials of racist character,
- violating the right to privacy,
- containing materials protected by copyrights without the author’s consent.
§ 5 LIMITATION OF LIABILITY AND PIWOPEDIA RESERVATION
- The user of beeropedia.org publishes at beeropedia.org any contents, in particular photographs, films and texts, solely on his/her own responsibility.
- The contents published by the users do not reflect Piwopedia’s views or opinions to either degree.
- Piwopedia does not take any responsibility for contents placed by the users.
- In particular, Piwopedia does not take responsibility for:
- any possible damage resulting from the users publishing contents or using the website,
- any damage resulting from beeropedia.org’s malfunctioning or its temporary unavailability,
- any damage taking place as a result of third parties taking possession of the user’s password,
- any further consequences of downloading information from the website,
- the users violating in any way property copyrights or third parties’ personal interests.
- Piwopedia does not ensure continuity or quality of beeropedia.org operations.
- Piwopedia does not monitor or control in a continuous way the contents published by the users. In cases of disclosing contents contrary to the regulations, it will make best efforts to remove them from the sites as soon as possible.
- Piwopedia reserves the right to:
- change the website’s functionality at any time, including the blog’s functionality and specifications,
- temporarily suspend the website’s operations,
- permanently disconnect the website after having properly informed about the fact on the website’s homepage without archiving the contents placed by the users,
- immediately and irrevocably remove a whole blog or any of its pars (e.g. a photograph, a film, text or link) without prior notification or explanation for the user in the case of violating the regulations. In such case, if the user has violated third parties’ rights Piwopedia may hand over information on the user to the relevant legal authorities for them to instigate possible explanatory proceedings.
- Piwopedia also reserves the right to demand immediate discontinuation of unwelcome activities which are not included in the regulations but may harm third parties’ interests. The user’s refusal to comply with such a demand will in such case be also deemed breach of the regulations.
§ 6 CHANGES TO THE REGULATIONS
- Piwopedia reserves the right to change these regulations at any time.
- These regulations are in force since XX XXXXX 2007 until cancelled.
- Any questions or comments on beeropedia.org operations or reports of failure to comply with the regulations should be sent to: kontakt@beeropedia.org
§ 7 COMPLAINT PROCEDURE
- Any complaints related to beeropedia.org operations should be reported not later than within 14 days upon the date when the person lodging the complaint finds out about an event laying ground for complaint but not later than within one month upon the day of disconnecting the website, in compliance with the information placed by Piwopedia on the home page.
- Complaints should be lodged in the form of an electronic message sent to: kontakt@beeropedia.org.
- Complaints lodged in line with terms and conditions stipulated in § 7.1. and § 7.2. will be considered within 7 days upon the date of lodging thereof interpreted as registration in the website’s IT system.
- The individual lodging a complaint will be notified about its consideration within 7 days upon its consideration. The notification referred to in the preceding sentence will be sent in the form of an electronic message to the Email address of the person lodging a complaint.
- The above complaint procedure shall not apply in the case of complaints made with respect to contests or promotions run at beeropedia.org when these contests’ or promotions’ regulations will govern the complaint procedure in a way different from the provisions of this § 7.
* Piwopedia indicates a section of Kompania Piwowarska S.A. seated in Poznań, at 11 Szwajcarska St., entered in the Domestic Court Register maintained by The Regional Court in Poznań, 21 Business Department of DCR under the number 0000086269, dealing with propagation of knowledge about beer and gathering beer gadgets collectors communities, further referred to as "Piwopedia”.
